1. Agreement to Terms
By accessing or using the services of Goosebumps Media ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
2. Services Description
Goosebumps Media provides digital marketing services including but not limited to:
- Performance Marketing (Meta Ads, Google Ads)
- Social Media Management
- Content Creation
- SEO & Website Building
- Website Design and Development
Specific deliverables, timelines, and pricing will be outlined in individual proposals or service agreements.
3. Client Responsibilities
As a client, you agree to:
- Provide accurate and complete information about your business
- Respond to requests for feedback, approvals, and materials in a timely manner
- Provide necessary access to social media accounts, ad managers, and website platforms
- Ensure you have rights to all content and materials you provide to us
- Make payments according to the agreed schedule
4. Payment Terms
- Proposal Approval: Work begins after proposal acceptance and initial payment (if applicable).
- Payment Methods: We accept bank transfer, UPI, and other secure payment methods.
- Invoicing: Invoices are sent according to the agreed payment schedule.
- Late Payments: Services may be paused for overdue payments. A late fee may apply.
- Refunds: Refunds are handled on a case-by-case basis. Retainer fees and work already completed are generally non-refundable.
5. Intellectual Property
- Our Work: Upon full payment, you receive rights to use the deliverables we create for your business. We retain the right to showcase the work in our portfolio.
- Your Materials: You retain ownership of all materials you provide to us.
- Third-Party Assets: We are not responsible for licensing of third-party assets (stock photos, fonts, etc.) unless explicitly agreed upon.
6. Confidentiality
We respect the confidentiality of your business information. We will not disclose sensitive information to third parties except as necessary to provide our services or as required by law.
7. Limitation of Liability
Goosebumps Media's liability is limited to the amount paid for the specific service giving rise to the claim. We are not liable for:
- Indirect, incidental, or consequential damages
- Loss of profits, revenue, or data
- Results from factors outside our control (platform algorithm changes, market conditions, etc.)
8. No Guarantees
While we strive for excellent results, we do not guarantee specific outcomes (e.g., number of sales, followers, or ROAS). Digital marketing results depend on many factors including market conditions, competition, and your product/service quality.
9. Termination
Either party may terminate the service agreement with written notice:
- Monthly retainers: 15 days notice
- Project-based work: According to the specific project agreement
Upon termination, you are responsible for payment for all work completed up to the termination date.
10. Governing Law
These Terms are governed by the laws of India. Any disputes will be subject to the jurisdiction of courts in Nagpur, Maharashtra.
11. Changes to Terms
We may modify these Terms at any time. Changes will be effective immediately upon posting. Continued use of our services constitutes acceptance of the updated Terms.
